By accessing or using tests.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

tests.com provides an online platform for companies ("Clients") to administer cognitive assessments to candidates. The Service includes test creation, invitation management, test delivery, scoring, result reporting, and integrity monitoring.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.

4. Free and Premium Plans

The Service offers a free tier with limited features and a premium tier with additional capabilities. Free tier users may send up to 5 test invitations per month. We reserve the right to modify plan features and pricing with reasonable notice.

5. Candidate Responsibilities

Candidates who take assessments through the Service agree to:

• Complete the test honestly and without external assistance
• Not use AI tools, search engines, or other resources during the test
• Not copy, share, or reproduce test questions
• Accept that their test behavior is monitored for integrity purposes

6. Integrity Monitoring

The Service monitors candidate behavior during tests to maintain assessment integrity. This may include tracking tab switches, focus events, copy/paste attempts, and other behavioral signals. Results may be flagged if suspicious activity is detected. These measures are essential to providing reliable assessments.

7. Intellectual Property

All test content, questions, algorithms, and platform code are the intellectual property of tests.com. Clients and candidates may not reproduce, distribute, or reverse-engineer any part of the Service.

8. Data Handling

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to data practices described therein.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for hiring decisions made based on assessment results. Test scores are one data point and should be considered alongside other evaluation methods.

10. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time through the Settings page. Upon termination, your data will be handled according to our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the European Union and the jurisdiction where our company is registered.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
